Proaucs operates solely as an independent technology service provider and intermediary that facilitates online auctions and transactions between Buyers and Sellers.

Proaucs does not own, purchase, inspect, possess, store, test, or guarantee any asset listed on the Platform unless expressly stated otherwise. All transactions are entered into directly between Buyers and Sellers.

Proaucs is not a party to any sale, contract, or dispute arising between Buyers and Sellers and accepts no responsibility for the conduct, performance, or default of any User.

Asset descriptions, quantities, specifications, photographs, grades, and other details displayed on the Platform are provided by Sellers or generated from information supplied to Proaucs.

Proaucs does not warrant or guarantee:

• The accuracy or completeness of any listing;
• The quantity, quality, or condition of any asset;
• The fitness of any asset for a particular purpose;
• The merchantability or availability of any asset.

Participation in any auction is undertaken at the User’s own discretion and risk. Every submitted bid is final and legally binding under the applicable auction rules.

Proaucs does not guarantee the outcome of any auction, the award of any lot, or the conclusion of any sale. The highest or lowest bid does not automatically result in a concluded transaction, and Sellers retain absolute discretion to accept, reject, or withdraw any bid or lot.

Proaucs shall not be responsible for bids that fail to register, connectivity interruptions, browser issues, or delays affecting participation in any auction.

Nothing on the Platform constitutes legal, financial, tax, valuation, environmental, regulatory, technical, or professional advice of any kind.

You should obtain independent professional advice before making any decision or entering into any transaction based on information available through the Platform.

Any indicative prices, reserve values, estimates, or valuations displayed on the Platform are provided for reference only and do not constitute an offer, guarantee, or representation of actual market value.

Final consideration, applicable taxes, duties, levies, and other charges are determined in accordance with the applicable auction and Seller-specific conditions.

References to recycling, e-waste management, EPR, sustainability outcomes, certifications, or environmental compliance describe general capabilities and objectives and do not constitute a warranty in respect of any specific transaction, asset, or outcome.

Buyers and Sellers remain solely responsible for compliance with all applicable environmental, statutory, and regulatory obligations arising from their transactions.

The Platform may contain links to third-party websites or rely on third-party hosting providers, payment gateways, logistics partners, communication services, or identity verification providers.

Such links and services are provided for convenience only. Proaucs has no control over, and accepts no responsibility for, the content, policies, availability, or practices of any third party, and the inclusion of any link does not imply endorsement.

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. Proaucs does not warrant that the Platform will be uninterrupted, timely, secure, or free of errors, viruses, or other harmful components.

Proaucs shall not be liable for any interruption, downtime, data loss, or unavailability arising from maintenance, technical failures, or circumstances beyond its reasonable control.

To the maximum extent permitted by law, Proaucs shall not be liable for any direct, indirect, incidental, consequential, or special loss or damage, including loss of profits, business, opportunity, or data, arising from your access to or use of the Platform or reliance on any information contained therein.

In all circumstances, Proaucs’ aggregate liability shall not exceed the total service fees actually received by Proaucs from the User in relation to the relevant transaction.

Proaucs reserves the right to amend, update, or modify this Disclaimer at any time without prior notice.

Any changes take effect immediately upon publication on the Platform, and your continued use of the Platform constitutes acceptance of the revised Disclaimer.

This Disclaimer shall be governed by and construed in accordance with the laws of India, and any dispute arising in connection with it shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.
